Utah Sues Kalshi and Susquehanna Over Alleged Illegal Gambling

Utah Attorney General Derek Brown sued prediction-market operator Kalshi and affiliated Susquehanna firms on Tuesday, October 20, 2026, accusing them of running illegal gambling in a state that bans it. Same-week coverage into October 21 from The Block and Utah News Dispatch puts the civil case in 3rd District Court. This is a Plain English Policy enforcement chapter — event contracts versus a state gambling ban — not an NFT marketplace rule change.

Defendants named in wraps: five Kalshi companies plus Susquehanna International Group and Susquehanna Government Products. The complaint likens KalshiEx to “the manager of a back-alley gambling den” that hosts bets and takes a rake. Utah also targets market-maker sides — Kalshi Trading and the Susquehanna entities — for allegedly taking the other side of user bets. Fee estimate through Oct 19: about $30.6 million to $61.2 million from Utah-linked accounts (state’s range; could move with discovery). Complaint color cited locally: ~$0.01–$0.02 per wager, more than $3 billion lifetime Utah-attributed volume, and 32,000+ verified Utah users. Remedies sought include returning allegedly illegal profits, restitution/damages, blocking sports, election, politics, culture, and “mentions” markets, and tighter court-approved location checks.

Context, not today’s filing: Connecticut and Baltimore sued Kalshi in August over unlicensed sports betting (Baltimore also named Coinbase, Robinhood, and Webull as distribution partners). In September a federal appeals court said Ohio and Tennessee could enforce sports-betting laws against Kalshi, rejecting a federal-preemption shield — Kalshi has said it expects that path overturned. Brown framed Utah’s action as civil for now and part of a “larger investigation” that could touch other platforms. Kalshi did not immediately comment in the Utah News Dispatch report. Sports attorney Daniel Wallach called this the first state AG case aimed at prediction-market market makers.

For NFT and marketplace desks, the useful cut is distribution risk: prediction-market apps sitting next to crypto super-apps (Robinhood, Coinbase, Webull already named in Baltimore’s earlier suit) can pull regulatory heat onto the same retail rails that sell NFTs and tokens. Do not treat Utah’s civil complaint as a nationwide Kalshi shutdown — no injunction grant is reported in today’s wraps — and do not conflate CFTC-registered event contracts with a free pass under every state gambling statute.

Prior OCC GENIUS final-rule LN stays a separate federal stablecoin chapter; today’s beat is a state AG gambling case against Kalshi and Susquehanna market makers. Fee figures are the state’s estimates, not audited Kalshi disclosures.

Policy watch: Watch whether a Utah judge grants interim relief blocking sports/election/culture/mentions markets, whether Kalshi answers with a federal preemption move, and whether Brown expands the “larger investigation” to Polymarket or other venues — the desk cares about enforceable geo blocks and named damages, not the press-conference slogan alone.

Bottom line: Utah’s AG sued Kalshi and Susquehanna market makers over alleged illegal gambling, citing about $30.6M–$61.2M in Utah-linked fees and seeking blocks on sports-to-“mentions” markets — civil case filed; injunction not yet decided in today’s wraps.
